Current registration situation in the EU

Council Directive of 15 July 1991 concerning the placing of plant protection products on the market (91/414/EEC) was suspended in 2009 and Regulation (EC) No 1107/2009 of 21 October 2009 "concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC" has been implemented since 14 June 2011, and now governs the approval of active substances in the EU.

Regulation (EC) No 1107/2009 of 21 October 2009 "concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC" must be seen in conjunction with Directive 2000/60/EC of 23 October 2000, establishing a framework for Community action in the field of water policy (Water Framework Directive, amended through Directive 2008/105/EG of 16 December 2008), as well as Directive 2009/128/EC of 21 October 2009 establishing a framework for Community action to achieve the sustainable use of pesticides (SUD - sustainable use Directive), and Regulation (EC) No 1185/2009 of 25 November 2009 concerning statistics on pesticide.

The transition of the already approved active substances is guided by Commission Implementing Regulation (EU) No 540/2011 of 25 May 2011, implementing Regulation (EC) No 1107/2009 of the European Parliament and of the Council as regards the list of approved active substances, and Commission Implementing Regulation (EU) No 541/2011 of 1 June 2011 amending Implementing Regulation (EU) No 540/2011 implementing Regulation (EC) No 1107/2009 of the European Parliament and of the Council as regards the list of approved active substances. Data requirements for active substances are laid down in Commission Regulation (EU) No 283/2013 of 1 March 2013, repealing Commission Regulation (EU) No 544/2011 of 10 June 2011. Transitional measures for data requirements for chemical active substances and plant protection products according to Commission Regulation (EU) No 283/2013 and Commission Regulation (EU) No 284/2013 are given in the guidance document SANCO/11509 /2013– rev. 3; 12 December 2014.
